The case came about as a result of a complaint lodged with the public protector by Rayno van Rooi, who has since died, after his application for the post was unsuccessful in 2017. Of all the candidates, only Van Staden and Van Rooi qualified for the post in terms of the criteria set by the municipality, with the former obtaining a marginally higher score. This follows an application by the farmers for an urgent interdict restraining the department from evicting or relocating them from a disputed piece of land without an eviction order. Acting Land Claims Court Judge President Yasmin Meer said if the allegations made in the urgent application by the residents, who are facing eviction and/or removal from farmland at Penhill, were true, then the matter was urgent and justified the relief they sought.
