Section 37 of the South African Constitution states that a state of emergency may be declared if, “(a) the life of the nation is threatened by war, invasion, general insurrection, disorder, natural disaster or other public emergency; and (b) the declaration is necessary to restore peace and order”.
President Ramaphosa, soon after the looting and destruction had taken place, stated in an address to the nation, “The attempted insurrection has failed.”
Based on the aforementioned, it is unfathomable that a state of emergency had not been announced by President Ramaphosa.
