A federal judge has sided with Facebook parent Meta and cleared the way for the company to buy virtual reality startup Within Unlimited, the maker of the popular fitness app Supernatural. Federal antitrust regulators had sought to block the acquisition on the grounds that it would hurt competition in the emerging virtual reality market. But U.S. District Judge Edward Davila denied the Federal Trade Commission’s request for a preliminary injunction against the deal. The judge’s ruling said the agency did not provide sufficient evidence to prove its case. Meta said it will now proceed with its acquisition of Within Unlimited. Government regulators announced that videogame maker Activision Blizzard has agreed to pay $35 million to settle charges that it failed to maintain controls to collect and assess workplace complaints with regard to disclosure requirements and violated a federal whistleblower protection rule. The lack of necessary controls left Activision “without the means to determine whether larger issues existed that needed to be disclosed to investors,” said Jason Burt, director of the SEC’s Denver office. “Moreover, taking action to impede former employees from communicating directly with the Commission staff about a possible securities law violation is not only bad corporate governance, it is illegal.” In paying the settlement, Activision neither admitted nor denied the SEC’s findings and agreed to a cease-and-desist order, the agency said. The panel of experts said in the wide-ranging report seen this week that the hackers used increasingly sophisticated techniques to gain access to digital networks involved in cyberfinance, and to steal information that could be useful in North Korea’s nuclear and ballistic missile programs from governments, individuals and companies.
